According to Resolution of the Cabinet of Ministers of Ukraine No. 1405 dated 29.12.2023 “On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine regarding Payment for Housing and Communal Services” (hereinafter – the Resolution), the prohibition on the suspension of housing and communal services, the imposition of fines and penalties, as well as the collection of arrears from the population for housing and communal services in territories that are not under occupation or where hostilities are ongoing has been lifted.
Thus, for consumers of communal services, the Resolution restores the accrual of penalties for non-payment of housing and communal services.
The Resolution also restores the possibility of collecting arrears for housing and communal services through court proceedings.
Moreover, the Government of Ukraine has reinstated the right to disconnect utility services for debtors in the event of non-payment or underpayment for the received services.
According to the Resolution, in case of temporary absence of the consumer or other persons from the dwelling for more than 30 calendar days, utility providers must receive a written application and documentary evidence in electronic or paper form.
Such documentation may include:
Certificates of temporary residence;
Certificates of employment, treatment, or study;
Certificates of military service (including service in a foreign country);
Certificates of serving a sentence, etc.
