Supply contract

Consumers have the right to freely choose their electricity supplier(s).

Electricity can be supplied to a consumer if the following conditions are met:

1) The consumer’s facility is connected to the distribution network in accordance with the procedure established by law.

2) The electricity supplier, under an agreement with the system operator, has access to the network and the right to sell electricity within the operator’s service area.

3) The consumer is a party to valid agreements on:

  • Distribution (transmission) of electricity services;
  • Supply of electricity to the consumer, supply by the universal service provider, or supply by the “supplier of last resort”;
  • Commercial electricity metering services (except when the role of the commercial metering service provider is performed by the system operator to which the consumer is connected).

4) A valid agreement with a commercial metering service provider exists for all commercial metering points at the consumer’s facility/facilities where electricity is supplied or planned to be supplied.

5) There is no suspension or termination of electricity supply or distribution (transmission) services as provided for by energy legislation.

6) There is no overdue debt under electricity supply agreements or distribution/transmission service agreements.

If the debt exceeds the cost of electricity consumed over the previous two months, the electricity supplier (except for the universal service provider or the “supplier of last resort”) has the right to terminate the electricity supply contract according to its terms, unless otherwise specified in the contract or commercial offer.

Contracts between the electricity supplier and the consumer are usually concluded by joining the supplier’s standard agreement under the terms of a commercial offer published by the supplier. The electricity supplier cannot refuse the consumer’s request to join the contract under the terms of a publicly published commercial offer, provided that the technical metering and measurement equipment allow the parties to comply with the conditions of the commercial offer.

Consumption of electricity without a corresponding retail market contract is not permitted.
