The consumer has the right to freely choose their electricity supplier(s).
Electricity supply to the consumer is provided if:
1) The consumer’s facility is connected to the distribution system operator’s network in accordance with the procedure established by law;
2) The electricity supplier, under a contract with the system operator, has obtained access to the network and the right to sell electricity within the system operator’s area of activity;
3) The consumer is party to valid contracts for:
- Distribution (transmission) services of electricity;
- Supply of electricity to the consumer or supply by a universal service provider, or supply by a supplier of last resort;
- Provision of commercial electricity metering services, except when the role of the commercial metering service provider is performed by the system operator to whose network the consumer is connected;
4) For all commercial metering points at the consumer’s facility (facilities) where electricity is supplied or planned to be supplied, a contract with a commercial metering service provider for provision of commercial metering services is concluded;
5) There is no fact of termination/suspension of electricity supply or distribution (transmission) services in cases stipulated by energy legislation;
6) There is no overdue debt under contracts for electricity supply or distribution/transmission services.
If the debt exceeds the cost of electricity consumed during the previous two months, the electricity supplier (except for the universal service provider and supplier of last resort) has the right to terminate the electricity supply contract in accordance with its terms, unless otherwise stipulated by the contract conditions (commercial offer).
The contract between the electricity supplier and the consumer is usually concluded by the consumer joining the supplier’s standard contract under the terms of the supplier’s published commercial offer.
The electricity supplier may not refuse the consumer’s accession to the contract under the officially published commercial offer terms if the technical means of electricity measurement and metering ensure fulfillment of the commercial offer conditions by both parties.
Electricity consumption without appropriate contracts on the retail electricity market is not permitted.
