Government Strengthens Oversight of Compliance in the Electricity and Heat Supply Sectors

The Cabinet of Ministers of Ukraine has adopted a decision to enhance state control in the electricity and heat supply sectors during martial law. In particular, amendments were made to Resolution No. 303 of 13 March 2022, which enable the State Inspectorate for Energy Supervision of Ukraine (Derzhenergonahliad) to fully carry out state energy supervision (control) measures.

Under this decision, Derzhenergonahliad will be able to monitor compliance with legislation in the electricity and heat supply sectors for all entities operating in these areas, including electricity producers, the transmission system operator, distribution system operators, and heat supply companies, in accordance with the Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity” throughout the period of martial law.

The need for these changes is driven by the increase in technological violations and accidents at energy infrastructure facilities.

To prevent violations in the operation of the Unified Energy System of Ukraine or its individual parts caused by power and electricity shortages, frequency drops, disruptions of permissible transfer modes, or network element overloads, Derzhenergonahliad will have the authority to conduct inspections of electricity and heat supply entities. This includes timely identification of potential organizational and technical causes of malfunctions and the development of organizational and technical measures to prevent future emergency situations in energy and heat supply facilities.

Implementation of this enhanced state supervision (control) will increase the accountability of economic entities for compliance with legislation, regulatory acts, technical standards, and rules, ensuring proper operation, safe exploitation, and reliable supply of electricity and heat.
